The following terms and conditions ("Terms of Service") govern your use of all the content and services located under the Quiet Riots domains www.quietriots.com and all affiliated Quiet Riots domains, such as www.quietriots.co.uk and www.quietriots.de ("the QR Service"). If you have any questions or comments about these Terms of Service, please join the discussion. All users must also abide by the Quiet Riots community guidelines, which can be viewed in the “About Us” section of the website.
The QR Service belongs to and is provided by Quiet Riots Limited ("Quiet Riots"), a limited liability company registered in England and Wales (company number 6180320) with an office address of:
Suite 11634, 2nd Floor, 145-157 St John Street, London, EC1V 4PY, United Kingdom.By using the QR Service, you are agreeing to be legally bound by these Terms of Service. If at any time you are not willing to be bound by all of these Terms of Service, then you must not use the QR Service.
Quiet Riots has complete discretion to update and change these Terms of Service from time to time, and to change the scope or features of the QR Service from time to time. When changes are made, we will notify you by making the revised version available on this webpage and will indicate at the top of this page the date that revisions were last made. You should revisit these Terms of Service on a regular basis as revised versions will be binding on you. Any such modification will be effective upon Quiet Riots's posting of new Terms of Service. If you continue to use the QR Service after any such changes you will be considered to have consented to them.
You must be 18 years old or older to participate in the QR Service.
Quiet Riots can refuse registration of, or cancel, an account in its discretion, at any time.
To use some of the features of the QR Service, you may be required to create an account and provide information about yourself to us. Your account will be accessed through a user ID and password that you will create (your "Credentials"). You are responsible for maintaining the confidentiality of your Credentials, and you are fully and solely responsible for all activities that occur under your Credentials. It is up to you to take adequate precautions with your Credentials, and to immediately notify Quiet Riots of any unauthorized use of your Credentials. There are two types of accounts:
A "Personal Account" is an account for your personal, non-commercial use only. In creating a Personal Account, we ask that you provide complete and accurate information about yourself to bolster your credibility as a contributor to the QR Service. You may not impersonate someone else (e.g., adopt the identity of a celebrity or your next-door neighbor), provide an email address other than your own, or create multiple Personal Accounts. Quiet Riots also allows you to choose a “display name” that will appear on your public profile and be shown to users viewing your profile and activity instead of your real name. Each Personal Account may only have one display name.
A "Business Account" is an account to be used solely for the purpose of representing your business on the QR Service. In creating or updating a Business Account, you must be an authorized representative of the business in question, and you must provide complete and accurate information about yourself and the business you represent,. You may not provide an email address that is not your own or create multiple Business Accounts for the same business.
Using your account, you may access and participate in the QR Service, including viewing, posting and responding to communications on the QR Service.
If you post your own text, images, photos, audio, video or any other forms of data or communication (collectively, "Content") on the QR Service, that Content still belongs to you, and you can use it in any other way without restriction. Content posted by another person or company belongs to the poster, and you can only use that Content in the ways described in these Terms of Service.
In order to operate the QR Service, Quiet Riots needs the right to make certain uses of your Content. Therefore, when you post Content on the QR Service, you agree to grant Quiet Riots an irrevocable, perpetual, worldwide, royalty-free, fully sublicenseable, non-exclusive license to copy, distribute, publicly display, publicly perform and make derivative works of your Content on the QR Service and on services affiliated with Quiet Riots regardless of the form of media used or of whether such services now exist or are developed in the future. If you post Content to the QR Service, then you hereby represent and warrant that you have the right to post that Content and to grant the above rights to Quiet Riots.
In addition to viewing the Content on the QR Service, in the future you may be able to access and use the Content on the QR Service for certain other purposes through the use of Quiet Riots's application programming interfaces ("APIs"). Quiet Riots has not released APIs yet, but these Terms of Use will be updated when the APIs are available.
Quiet Riots owns the QR Service as a whole, including but not limited to visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate user review ratings, and all other elements and components of the QR Service . The QR Service as a whole, the computer code of the QR Service, the user interface and graphic elements are all copyrighted works of Quiet Riots. Various other aspects of the QR service may be protected by intellectual property laws including copyright, trademark, patent and trade secrets.
Quiet Riots has the right, but not the obligation, to remove Content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable, that violates any party's intellectual property, or that is detrimental to the quality or intended spirit of the QR Service. Quiet Riots also has the right, but not the obligation, to limit or revoke the use privileges of the account of anyone who posts such Content.
Quiet Riots will use common sense and business sense regarding allowable Content on the QR Service. Examples of unacceptable Content or behavior on the QR Service include:
Quiet Riots cannot and need not control all Content posted by third parties to the QR Service, and does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the QR Service you may be exposed to Content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will Quiet Riots be liable in any way for any Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of your use of any Content. You understand that you must evaluate and bear all risks associated with the use of any Content, including any reliance on the content, integrity, and accuracy of such Content. If you would like to report objectionable materials, you may use the flagging feature by clicking the link attached to every topic post and reply or email us directly at support@quietriots.com
Except where expressly permitted, you do not have the right to use, copy, transmit, modify or repurpose any Content that does not belong to you, other than viewing of the Content on the QR Service and use of the Content through such APIs as Quiet Riots may make available.
You do not have any rights to the QR Service that have not been granted to you expressly. By way of example only, you do not have the right to modify, adapt, translate, or reverse engineer any portion of the QR Service, and you do not have the right to index or aggregate any portion of the QR Service (either by hand or by means of a robot, spider, or other device).
Quiet Riots respects the intellectual property of others. We may, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who repeatedly infringe others' rights. If you are a copyright owner or agent thereof, and believe that your copyright is being infringed in connection with the QR Service, please send a written notification to the address for infringement notifications set out below detailing the alleged infringement. Use of the QR Service is also governed by our Privacy Policy
We make some of the QR Service Content (the "Feed Content") available via online solutions such as RSS (the "Feeds"). You may access and use the Feeds in order to display Feed Content on your personal computer, website, or blog, provided that (a) your use of the Feeds is for personal, non-commercial purposes only, (b) your display of the Feed Content links back to the relevant pages on the QR Service and attributes Quiet Riots as the source of the Feed Content, (c) your use or display of the Feed Content does not suggest that Quiet Riots promotes or endorses any third party causes, ideas, web sites, products or services, (d) you do not redistribute the Feed Content, and (f) your use of the Feeds does not overburden Quiet Riots’ systems. Quiet Riots reserves all rights in the Feed Content and may terminate the Feeds at any time.
If you are dissatisfied with the QR Service, please provide feedback through the “contact us” page on our website. Your only other remedy with respect to any dissatisfaction with (i) the QR Service, (ii) the Terms of Service, (iii) any policy or practice of Quiet Riots in operating the QR Service, or (iv) any content or information transmitted through the QR Service, is to terminate your account and cease using the QR Service.
We appreciate your feedback and suggestions. Please note, however, that by sending us any ideas, suggestions, documents or proposals ("Feedback"), you agree that (i) your Feedback does not contain the confidential or proprietary information of third parties, (ii) we are under no obligation of confidentiality, express or implied, with respect to the Feedback, (iii) we may have something similar to the Feedback already under consideration or in development, and (iv) you grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, publish, distribute and sublicense the Feedback.
These Terms of Service will remain in full force and effect while you use the QR Service. Those terms capable of continuation after you stop using the QR Service (including, without limitation, your Content license to Quiet Riots and the General Terms in this Section), will survive after you stop using the QR Service.
You agree to indemnify and hold Quiet Riots, its parents, subsidiaries, affiliates, any related companies, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party due to or arising out of (i) your access to or use of the QR Service, (ii) the violation of these Terms of Service by you, or any third party using your account, or (iii) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Quiet Riots reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us and you agree to cooperate with our defence of these claims. You agree not to settle any matter without the prior written consent of Quiet Riots. Quiet Riots will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

The QR service is provided "as is" with no representations or warranties of any kind, express, statutory or implied, as to the operation of the QR service, or the information, content, materials, or products included on the QR service. To the fullest extent permissible by applicable law, Quiet Riots and its affiliates disclaim all warranties, express, statutory, or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement. Further, Quiet Riots and its affiliates do not warrant the accuracy or completeness of the information, text, graphics, links or other information contained in the QR service. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you. Quiet Riots does not warrant that the QR service will be available at any particular time or from any particular location, will be secure or error-free, that defects will be corrected, or that the QR service is free of viruses or other potentially harmful components. No advice or information, whether oral or written, obtained from Quiet Riots or the QR service shall create any warranty not expressly stated in these terms of service.
Quiet Riots and its affiliates will not be liable under any theory of law, for any indirect, incidental, punitive, or consequential damages, including, but not limited to loss of profits, business interruption, and/or loss of information or data. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.
Quiet Riots also disclaims all liability for any loss or damage arising out of your communications or dealings with any of the businesses, advertisers, or users on the QR service. Your communications or dealings with such businesses, advertisers, and users are solely between you and them, though Quiet Riots reserves the right (but has no obligation) to monitor disputes between you and them.
Notwithstanding anything to the contrary contained herein, Quiet Riots’ maximum aggregate liability to you for any causes whatsoever, and regardless of the form of action, will at all times be limited to the greater of (i) the amount paid, if any, by you to Quiet Riots for the QR service in the 12 months prior to the action giving rise to liability or (ii) one hundred pounds sterling (£100.00).
Notwithstanding the foregoing, neither party's liability is excluded or limited by these terms of service in connection with any of the following: (a) death or personal injury caused by Quiet Riots’ negligence or the negligence of Quiet Riots’ employees or agents; (b) part I of the U.K. Consumer Protection Act 1987; or (c) fraudulent misrepresentation.
These Terms of Service shall be governed and interpreted in accordance with English law, and you consent to the exclusive jurisdiction of the English courts.
No agency, partnership, joint venture, or employment is created as a result of the Terms of Service, and you do not have any authority of any kind to bind Quiet Riots in any respect whatsoever.
Quiet Riots may provide you with notices, including those regarding changes to the Terms of Service by email, regular mail or postings on the QR Service.
Nothing herein is intended, nor will be deemed, to confer rights or remedies upon any third party.
The Terms of Service (including the Privacy Policy) contain the entire agreement between you and Quiet Riots regarding the use of the QR Service, and supersede any prior agreement between you and Quiet Riots on such subject matter. Notwithstanding the foregoing, with respect to Business Accounts, these Terms of Service shall be subject to and shall not supersede any additional or alternative terms agreed in a separate written agreement. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms of Service.
The failure of Quiet Riots to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
If any provision of the Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Service shall otherwise remain in full force and effect and be enforceable.
The Terms of Service are not assignable, transferable or sublicensable by you except with Quiet Riots’ prior written consent, but may be assigned or transferred by Quiet Riots without restriction. Any assignment attempted to be made in violation of the Terms of Service shall be void.
The section titles in the Terms of Service are for convenience only and have no legal or contractual effect.
